TERMS OF SERVICE
OVERVIEW
This website and online store are operated under the trading name Triple C Poultry by the trustee for the TRIPLE CCC INVESTMENT TRUST (ABN 36 354 288 473).
Throughout these Terms of Service, “Triple C Poultry”, “we”, “us” and “our” refer to the operator of Triple C Poultry. “Customer”, “you” and “your” refer to any person or business accessing our website or purchasing our products.
These Terms of Service apply to retail and wholesale customers. By accessing our website, creating an account or placing an order, you agree to these Terms and any policies referenced in them.
If you do not agree with these Terms, you must not use our website or place an order.

ELIGIBILITY AND CUSTOMER ACCOUNTS
You must be at least 18 years old and have the legal capacity and authority to place an order.
If you place an order for a company, school, association, partnership, trust or other organisation, you confirm that you are authorised to act on its behalf.
You must provide accurate, current and complete account, billing, delivery and contact information.
You are responsible for protecting your account credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorisation.
Accounts may not be transferred or shared with another person or business without our permission.

RETAIL AND WHOLESALE CUSTOMERS
Wholesale access and wholesale pricing are available only to customers approved by Triple C Poultry.
Wholesale customers must provide accurate business information and use their wholesale account only for legitimate business purposes.
Products purchased through an approved wholesale account may be used or resold in the normal course of the customer’s business, subject to applicable food-safety, storage, labelling and resale requirements.
We may suspend or remove wholesale access if an account is used fraudulently, shared without permission or otherwise misused.
Any separate written wholesale, credit or trading terms agreed with a customer will also apply. If those separately agreed terms conflict with these Terms, the separately agreed terms will apply to the extent of the inconsistency.

PRODUCT INFORMATION
We take reasonable care to ensure product names, descriptions, pack sizes, prices and images are accurate.
Product photographs may include serving suggestions and may not show the exact product, packaging or presentation supplied. Natural variations in size, shape, colour, crumb coverage and appearance may occur.
Packaging, recipes, ingredients, nutritional information and product specifications may change. Customers should always check the product label supplied with the product before use.
Nothing in this section limits any rights that may apply where a product is materially different from its description or does not meet an applicable consumer guarantee.

ALLERGENS AND FOOD INFORMATION
Some products may contain or come into contact with allergens.
Customers are responsible for checking the ingredient and allergen information on the product packaging before preparing, serving or consuming a product.
Please contact us before ordering if you require additional product or allergen information. Customers must not rely solely on photographs or general website descriptions when managing a food allergy or dietary requirement.

FROZEN PRODUCTS, STORAGE AND COOKING
Unless otherwise stated, our products are supplied frozen.
Products may be raw, partially cooked or fully cooked, as stated on the product label. A partially cooked product must not be treated as ready to eat.
Customers must:
• Maintain appropriate frozen storage after delivery or collection
• Follow all storage, thawing, handling and cooking instructions
• Prevent cross-contamination
• Ensure products are cooked to a safe internal temperature where required
• Comply with applicable food-safety requirements when using or reselling products
Triple C Poultry is not responsible for deterioration or damage caused after delivery or collection by incorrect storage, thawing, handling, preparation or cooking. This does not limit rights relating to the condition of a product when it was supplied.

ORDERS AND ACCEPTANCE
Submitting an order constitutes an offer to purchase the selected products.
An automated email acknowledging receipt of an order does not necessarily mean that the order has been finally accepted. We may review an order before accepting and preparing it.
We may decline or cancel an order where reasonably necessary, including because:
• A product is unavailable
• The price or product information contained a clear error
• Payment cannot be authorised
• The delivery address is outside our service area
• We reasonably suspect fraud or unauthorised account use
• We cannot safely or lawfully supply the order
If we cancel an order after payment has been received, we will provide a refund for the cancelled amount using the original payment method unless another arrangement is agreed.
We will not substitute a materially different product without the customer’s agreement.

PRODUCT AVAILABILITY AND QUANTITIES
Products and stock availability may change without notice.
We may place reasonable limits on order quantities where stock is limited or where an unusually large order cannot be fulfilled.
If an ordered product becomes unavailable, we will contact the customer to discuss an alternative, account credit, refund or other appropriate solution.

PRICES, GST AND PAYMENT
All prices are displayed in Australian dollars.
Prices displayed to retail customers include GST where applicable. Wholesale pricing will state whether GST is included or excluded. The checkout total will show the amount payable before the order is submitted.
Delivery fees and any other applicable charges will be shown during checkout.
Prices and promotions may change without notice, but changes will not affect an order that has already been accepted unless there is an obvious pricing error and the customer agrees to the correction.
Payment must be made using one of the payment methods offered during checkout unless separate written credit terms have been approved by Triple C Poultry.
Customers must be authorised to use the selected payment method and must provide accurate payment information.

DELIVERY AND PICKUP
Delivery and pickup are governed by our Shipping and Pickup Policy, which forms part of these Terms.
Customers must provide an accurate delivery address, safe access and any necessary delivery instructions.
Risk in an order passes to the customer when the order is delivered to the nominated location or collected by the customer or their authorised representative. This does not exclude any rights relating to loss, damage or a problem that existed before or at the time of delivery or collection.
Estimated delivery and pickup times are not guaranteed. If we cannot supply an order within the agreed timeframe or within a reasonable time, we will contact the customer and provide an appropriate solution.

CANCELLATIONS, RETURNS AND REFUNDS
Order cancellations, product problems, returns, replacements and refunds are governed by our Return and Refund Policy, which forms part of these Terms.
Because our products are frozen and perishable, an order generally cannot be cancelled after preparation or fulfilment has commenced.
This restriction does not exclude any rights or remedies available under the Australian Consumer Law.

WEBSITE ACCURACY AND ERRORS
We may correct typographical errors, inaccurate descriptions, pricing errors or omissions appearing on the website.
If an error affects an order that has already been submitted, we will contact the customer before making a material change. The customer may accept the correction or cancel the affected product for a refund.
We do not guarantee that the website will always be uninterrupted or free from technical errors, but we will take reasonable steps to maintain its availability and correct known problems.

PERMITTED USE
You may use our website only for lawful personal or business purchasing purposes.
You must not:
• Use the website fraudulently or unlawfully
• Attempt to access another customer’s account
• Circumvent wholesale-account restrictions or security features
• Upload malware or interfere with the website’s operation
• Collect personal information about other users without permission
• Copy or commercially exploit website content without authorisation
• Use automated tools in a way that damages, overloads or disrupts the website
We may suspend access where we reasonably believe these Terms have been breached or the website, Triple C Poultry or another customer is at risk.

INTELLECTUAL PROPERTY
Unless otherwise stated, the website’s text, branding, logos, graphics, photographs and other original content are owned by or licensed to Triple C Poultry and are protected by applicable intellectual-property laws.
Content may not be reproduced, republished, modified, distributed or commercially used without prior written permission, except where permitted by law.
Third-party names, brands, photographs and trademarks remain the property of their respective owners.

THIRD-PARTY SERVICES AND LINKS
Our website may use or link to services supplied by third parties, including payment processors, applications and external websites.
Third-party services may be governed by their own terms and privacy policies. Triple C Poultry is not responsible for external content or services outside our reasonable control.
Nothing in this section limits any responsibility Triple C Poultry has for services it directly provides or arranges as part of an order.

RELATIONSHIP WITH SHOPIFY
Triple C Poultry is powered by Shopify, which enables us to provide the online store and related services.
However, any sales and purchases made through our store are made directly with Triple C Poultry. Shopify is not the seller of the products offered by Triple C Poultry and is not responsible for fulfilling customer orders.

PRIVACY
Personal information collected through the website is handled in accordance with our Privacy Policy.
Because our website is hosted by Shopify, Shopify and service providers involved in operating the store, processing payments and fulfilling orders may also process customer information.

AUSTRALIAN CONSUMER LAW
Our products come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, restricted or modified.
Depending on the circumstances, Australian Consumer Law protections may also apply to purchases made for business purposes.

LIABILITY
To the extent permitted by law, Triple C Poultry is not responsible for loss caused by:
• A customer providing incorrect order or delivery information
• Improper storage, thawing, handling, preparation or cooking after delivery or collection
• Unauthorised use of a customer account
• Events outside our reasonable control where we have taken reasonable steps to provide a solution
Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, personal injury caused by negligence or any other liability that cannot lawfully be excluded or limited.
Where our liability may lawfully be limited, it will be limited only to the extent that is fair and reasonable in the circumstances.

TERMINATION AND SUSPENSION
A customer may stop using the website at any time.
We may suspend or terminate an account where reasonably necessary because of fraud, unlawful conduct, repeated non-payment, misuse of wholesale access, a material breach of these Terms or a risk to another person or the website.
Termination does not affect rights, obligations or payments that arose before termination.

CHANGES TO THESE TERMS
We may update these Terms when our business practices, website features or legal obligations change.
The current version will be published on this website. Material changes will apply from the date stated or from the date they are published.
Changes will not retrospectively alter an order already accepted unless required by law or agreed with the customer.

GOVERNING LAW
These Terms are governed by the laws of Queensland and the Commonwealth of Australia.
The parties submit to the jurisdiction of the courts and tribunals of Queensland and any courts entitled to hear appeals from them.
Nothing in this section prevents a customer from exercising a right available under a mandatory law in another applicable jurisdiction.

SEVERABILITY AND ENTIRE AGREEMENT
If any part of these Terms is found to be unlawful or unenforceable, that part will be removed or limited to the minimum extent necessary. The remaining provisions will continue to apply.
These Terms, together with our Privacy Policy, Shipping and Pickup Policy, Return and Refund Policy and any separately agreed written trading terms, form the agreement governing use of our website and online purchases.
